Terms of Service

These Terms of Service ("Terms") are published in accordance with the Information Technology Act, 2000 ("IT Act") and the rules framed thereunder, and the Consumer Protection (E-Commerce) Rules, 2020 framed under the Consumer Protection Act, 2019. They constitute an electronic record and, per Section 10A of the IT Act, an electronic contract that does not require physical or digital signature to be valid and enforceable. These Terms govern your access to and use of www.freakfits.com and any order placed with FREAKFITS ("FreakFits", "we", "us", "our"). By browsing the site, creating an account, or placing an order, you agree to be bound by these Terms.

1. E-Commerce Entity Disclosures

As required under Rule 5 of the Consumer Protection (E-Commerce) Rules, 2020:

2. Accounts & Eligibility

• You must provide accurate registration information — a valid email and mobile number — and verify your email via a one-time passcode (OTP) before your account is activated.
• You are responsible for maintaining the confidentiality of your password and for all activity under your account. Notify us immediately of any suspected unauthorized access.
• You must be competent to contract under the Indian Contract Act, 1872 (generally, 18 years or older), or place an order with the involvement and consent of a parent or guardian if you are a minor.
• Impersonating another person, or posting a review or message under a false identity, is prohibited.

3. Products, Pricing & Description Accuracy

• In accordance with Rule 6(5) of the Consumer Protection (E-Commerce) Rules, 2020, we make reasonable efforts to ensure that product descriptions, images, pricing, and stock availability displayed on the site are accurate. Colours may vary slightly depending on your screen.
• We reserve the right to correct genuine pricing or listing errors, even after an order is placed, and to cancel and fully refund an order affected by such an error, in which case you will be notified promptly.
• Prices displayed include the applicable breakup of taxes and charges at checkout. The price and stock shown at the point of payment are always recalculated directly against our database — never trusted from your browser — so what you are charged reflects the live, verified price at the time of purchase.
• FreakFits products are fan merchandise, manufactured and printed in India (country of origin: India), and are not official club-licensed merchandise (see Section 12).

4. Order Placement & Acceptance

• Placing an order is an offer to purchase. An order is confirmed only once payment has been successfully verified — see Section 6.
• We may decline or cancel an order in cases including suspected fraud, a genuine pricing or stock error, or where a customized item can no longer be produced as specified.
• Jerseys ordered with a custom name/number are made to your specification. Please verify spelling and numbering carefully before completing checkout.

5. Unfair Trade Practices

In accordance with Rule 6 of the Consumer Protection (E-Commerce) Rules, 2020, we do not engage in unfair trade practices, including manipulating the price of any product to gain unreasonable profit, or falsely representing a product's quality, features, or origin. We do not discriminate between customers of the same class in a manner that is unfair or arbitrary.

6. Payments

• Payments are processed through Razorpay, a PCI-DSS-compliant payment gateway. We accept the payment methods Razorpay makes available (cards, UPI, net-banking, wallets).
• An order is written to our database only after Razorpay's payment signature has been cryptographically verified, protecting both parties from a falsely reported "payment successful" event.
• Your card, UPI, and bank details are entered directly into Razorpay's secure interface; FreakFits's own servers never receive or store them.
• In the rare case a payment is captured by Razorpay but an order fails to finalize on our side due to a technical fault, it is logged internally for manual reconciliation — no successful payment is silently lost. Contact us with your payment reference if this happens to you.

7. Coupons & Promotions

Coupon codes are subject to their own stated terms (expiry, minimum order value, usage limits) and may be redeemed only once per customer account. We validate coupons both at the time you apply them and again, authoritatively, at payment time, and reserve the right to void an order where a coupon has been applied fraudulently or in error.

8. Shipping & Delivery

We aim to dispatch and deliver orders within the timeframe indicated at checkout or in your order confirmation email; these timelines are estimates. You will receive email updates as your order's status changes. Shipping is free above the order-value threshold shown at checkout; a flat shipping fee applies below that threshold.

9. Cancellation Policy

You may cancel an order yourself from "My Orders" while it remains in Pending or Confirmed status. A successful cancellation automatically restores stock and any coupon usage tied to that order, and you will receive a cancellation confirmation email. Once an order has moved to Preparing, Packing, or Shipped, it can no longer be self-cancelled — please use the returns process (Section 10) or contact support instead.

10. Return, Refund & Exchange Policy

• Return and exchange claims must be submitted through our Returns & Claim Desk within the window stated on that page.
• To protect both you and us in the event of damage or mismatch, claims require unboxing video proof — either uploaded directly (up to 10MB) or submitted as a link from YouTube or Google Drive only.
• Our support team reviews each claim and will approve, reject, or mark it refunded. Approved refunds automatically restore stock and any coupon usage tied to the order.
• Items that are customized with a name/number, worn, washed, or returned without the required video proof may not be eligible for return, except where required by law or where the item is genuinely defective or materially not as described.
• Where a refund is due, it will be processed to your original payment method within the timeframe communicated to you at the time your claim is approved.

11. Reviews & Ratings

• You may leave a review under your own account for products you have purchased. Reviews are tied to your authenticated account, not a free-text name, so you may only edit or delete your own reviews, and no one can post a review impersonating another customer.
• We do not create, edit, incentivize, or publish fake or misleading reviews, consistent with the principles for genuine consumer reviews under the Consumer Protection (E-Commerce) Rules, 2020 and the national standard on online consumer reviews (IS 19000:2022).
• Do not post content that is false, defamatory, obscene, infringing, or otherwise unlawful. We may remove any review or uploaded photo at our discretion.

12. Intellectual Property & Fan-Made Disclaimer

All FreakFits branding, site design, and original content are our property or used under license and are protected under the Copyright Act, 1957 and the Trade Marks Act, 1999. You may not copy, reproduce, or repurpose site content for commercial use without our written permission.

13. Prohibited Conduct & Unauthorized Access

You must not, and must not attempt to:

• Gain unauthorized access to the site, another user's account, or any computer resource forming part of our systems, or introduce any virus, worm, or malicious code — conduct which may attract civil liability under Section 43 and criminal liability under Section 66 of the IT Act.
• Probe, scan, or attempt to bypass rate limits, authentication, or access controls.
• Use the site for any purpose that is unlawful under Indian law, including but not limited to the publication of obscene material (Section 67, IT Act) or fraudulent transactions (Section 66D, IT Act).

14. Liability & Indemnification

To the extent permitted by law, FreakFits is not liable for indirect, incidental, or consequential damages arising from your use of the site or a product purchased through it. Nothing in these Terms limits any right or liability that cannot lawfully be limited under the Consumer Protection Act, 2019 or other applicable Indian law, including liability for a defective or deficient product or service. Our total liability for any claim relating to an order is limited to the amount you paid for that order. You agree to indemnify FreakFits against claims arising from your breach of these Terms or misuse of the site.

15. Grievance Redressal

In accordance with Rule 5(3) of the Consumer Protection (E-Commerce) Rules, 2020, we have appointed a Grievance Officer to address consumer complaints relating to orders, products, or these Terms.

We will acknowledge your complaint within 48 hours and endeavour to redress it within one month from the date of receipt.

16. Suspension & Termination

We may suspend or terminate your account if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or misused the platform. You may close your account at any time from your Profile page or by contacting us; see our Privacy Policy for what happens to your data when you do.

17. Force Majeure

We will not be liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, strikes, courier or logistics disruptions, or governmental action.

18. Governing Law & Dispute Resolution

These Terms are governed by the laws of India, including the Information Technology Act, 2000 and the Consumer Protection Act, 2019 and the rules framed thereunder. Subject to your rights as a consumer to approach the appropriate Consumer Disputes Redressal Commission under the Consumer Protection Act, 2019, any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts at [City], India.

19. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court or the Data Protection Board of India (or successor authority), the remaining provisions will continue in full force and effect.

20. Changes to these Terms

We may revise these Terms from time to time, including to reflect changes in applicable law. We will update the "Last updated" date above whenever we do. Continuing to use the site after changes take effect constitutes your acceptance of the revised Terms.
